Terms of Use

These terms cover the Artsplainer mobile app, desktop companion app, and Adobe plugins (collectively, “the Service”), operated by Jolly Good Apps (“we”, “us”). By using the Service, you agree to these terms.
What the Service Does
Artsplainer analyses images of artwork using AI. You submit an image, choose an analysis type, and receive a written critique. The Service is available as a phone app, a desktop companion app for Windows, and as plugins for Adobe Lightroom Classic and Photoshop.
Your Account
An account is created automatically when you first open the phone app, linked to a random device identifier. No sign-up form or email address is required.
The desktop companion app and Adobe plugins connect to your phone account via a pairing process. They do not have separate accounts — your phone is the primary device that manages your identity and credits.
You are responsible for your account and any activity on it. Do not share your pairing session keys with others.
Credits and Payments
- The Service uses a credit-based system. Each analysis consumes a set number of credits depending on the analysis type chosen.
- You receive free credits when you first create an account.
- Additional credits can be purchased through the phone app.
- Credits do not expire.
- Credits are non-refundable, except where an analysis fails due to a technical error or automated content moderation — in these cases, credits are refunded automatically.
- Credit balances cannot be transferred between accounts.
- We reserve the right to change credit pricing at any time. Any credits already purchased remain valid at their original value.
Group Membership
If you belong to an organisation that uses Artsplainer (such as a photography club or art school), you may optionally link your email address to access bonus credits and group-specific features. Group membership is governed by your organisation’s own terms in addition to these.
Acceptable Use
You may use the Service for personal, educational, or professional purposes related to artwork analysis. You agree not to:
- Submit content that is illegal, abusive, or violates the rights of others
- Attempt to circumvent credit costs, content moderation, or usage limits
- Use the Service to generate content for the purpose of harassment or deception
- Reverse-engineer, scrape, or automate access to the Service beyond normal use
- Resell or redistribute the Service or access to it
Content Moderation
All images are automatically screened for inappropriate content before being sent to the AI provider. This is required to comply with our AI providers’ acceptable use policies. The screening is fully automated — no human views your images.
Images rejected by the automated screening are not stored, and credits are refunded automatically. We cannot override or bypass the screening for individual images. See our Privacy Policy for full details on how images are handled.
AI-Generated Content
- All analysis text is generated by third-party AI systems (currently OpenAI and Anthropic).
- AI output is provided as-is, for informational and educational purposes only.
- We do not guarantee the accuracy, completeness, or usefulness of any analysis.
- AI-generated scores and critiques are subjective interpretations and should not be treated as definitive assessments of artistic merit.
- You should not rely on the Service for consequential decisions (competition entries, professional valuations, etc.) without independent judgement.
Your Content
You retain all rights to images you submit. We do not claim any ownership of your images or the analysis results.
By submitting an image, you grant us a temporary, limited licence to transmit it to our AI provider solely for the purpose of generating your analysis. Images are deleted immediately after processing — we do not store them.
You are responsible for ensuring you have the right to submit any images you send for analysis.
Usage Data
We log anonymous usage data (such as which analysis types are used and how often) to help us improve the Service. This data is linked to your device identifier, not to your email address or personal identity. We do not use third-party analytics or ad tracking in the apps. See our Privacy Policy for full details.
Third-Party Services
The Service relies on third-party AI providers to generate analyses. These providers process your images under their own API terms of service, which include commitments not to use your data for model training. We are not responsible for changes to third-party services that may affect the quality, availability, or nature of the analyses.
Desktop Companion App and Plugins
The desktop companion app and Adobe plugins are provided as convenience tools to send images from your computer for analysis. They connect to your phone account and share the same credit balance. Use of the companion app and plugins is governed by these same terms — no separate agreement applies.
Availability and Changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will make reasonable efforts to provide notice and honour any outstanding credit balances.
Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided “as is” without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
- Our total liability to you for any claim arising from the Service is limited to the amount you have paid us in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these terms or if we reasonably believe your use poses a risk to the Service or other users.
Changes to These Terms
If we make changes, we will update this page and the date above. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
